Consumer Health Data Privacy Policy

This notice describes how Evidari handles consumer health data and how you can exercise your rights.

1. What this policy covers

“Consumer health data” means personal information that identifies or can reasonably be linked to a consumer and that identifies the consumer’s past, present, or future physical or mental health status. This can include information about health conditions, symptoms, treatments, medications, nutrition, fitness, sleep, reproductive or sexual health, measurements, and health-related inferences.

This policy supplements our Privacy Policy. Evidari is not a health care provider, and information you provide to Evidari generally is not protected by the Health Insurance Portability and Accountability Act (“HIPAA”) unless expressly stated otherwise.

2. Categories of consumer health data we collect

Depending on the features you choose to use, we may collect:

  • health conditions, status, symptoms, goals, concerns, and self-reported history;
  • medications, supplements, treatments, procedures, and care information;
  • nutrition, activity, fitness, sleep, and other wellness information;
  • bodily measurements, vital signs, lab-related information, and similar metrics;
  • reproductive, sexual, mental, or behavioral health information you choose to provide;
  • information from devices, applications, records, or services you choose to connect; and
  • health-related insights, recommendations, or inferences generated from the information above.

3. Sources of consumer health data

We collect consumer health data directly from you; from your interactions with the Services; from devices, applications, or services you choose to connect; and from other people or sources you direct to provide information to us. We may derive health-related insights from data you provide or authorize us to receive.

4. Why and how we collect, use, and process it

We collect and use consumer health data as reasonably necessary to provide features you request, personalize your experience, display insights or recommendations, maintain and improve the Services, respond to you, protect the security and integrity of the Services, prevent fraud or misuse, and comply with law.

Consumer health data may be processed electronically in systems used to host, store, organize, analyze, retrieve, secure, and display information. We collect or use consumer health data with your consent or as necessary to provide a product or service you request, as permitted by applicable law.

5. Categories of data shared and recipients

We may share the categories of consumer health data described above only as reasonably necessary:

  • with vendors that process data on our behalf, such as cloud hosting, data storage, security, and support providers;
  • with a person, application, device, or service when you direct or authorize the connection or disclosure;
  • to protect the Services, users, or others, or to comply with applicable law; or
  • with your separate consent.

Evidari has no affiliates with which it shares consumer health data as of the effective date of this policy. We do not sell consumer health data. We do not permit third-party advertising networks to collect consumer health data through the Services over time and across unrelated websites or online services.

6. Your consumer health data rights

Depending on where you live, you may have the right to:

  • confirm whether we collect, share, or sell your consumer health data;
  • access the consumer health data we maintain about you;
  • receive a list of third parties or affiliates with whom your consumer health data has been shared or sold;
  • withdraw consent and ask us to stop collecting or sharing your consumer health data;
  • request correction of inaccurate consumer health data; and
  • request deletion of your consumer health data.

Submit a request by emailing privacy@evidari.ai. Describe the right you want to exercise and provide enough information for us to locate your account or request. We may ask for information needed to authenticate your identity. You may use an authorized agent where permitted by law.

If we deny your request, you may appeal by replying to our decision or emailing the same address with “Privacy Appeal” in the subject line. If your appeal is denied, you may contact your state attorney general, including the Washington Attorney General or the Nevada Attorney General, as applicable.

7. Changes to this policy

We will post updates here and revise the effective date. If required, we will notify affected consumers and obtain consent before collecting, using, or sharing additional categories of consumer health data or using data for materially different purposes.
